Biography of lies by Nithyananda

Dear Friends,

Like me, many of you have followed Nithyananda blindly, accepting whatever he had to say and giving up your life and wealth to him and his mission. Fortunately, I came across evidence to show that he was not what he claimed to be. His entire self and mission were built on lies, and now lie in ruins.

Now knowing these facts, many of his senior acharyas, organizers and also ordained brahmacharis and sanyasis have moved away from him, both in India and USA, because they have lost faith in him. Nithyananda should be called Mithyananda, because whatever he said and did was based on falsehood. Because of him, many people have now lost faith in the Vediic tradition and the entire concept of Self Realization or Enlightenment. What he has done claiming to be an enlightened being has traumatized many people.

Here is a biography of his lies.

1. Nithyananda claimed in his authorized biography that he was born on 1 January 1978, in the Tamil month of Margazhi, in Chitra nakshatra, Kanya rasi, ashtami tithi in kanya lagna. We went to the panchang and nothing matched on this date. You can also google and find out.

Nithyananda's passport says he was born on 13 march 1977. None of his astrological details match this date also. So it was a fictional date and a fictional birth. The problem is that the Government of India can prosecute him for false date of birth given for passport and he can be barred forever from USA and other countries.

What about the prediction by his family astrologer that he will be a raja sanyasi? If he is still alive we can talk to him.

Nithyananda says in his biography that based on these very auspicious signs of his birth, he is an incarnation. He has claimed to be an avatar. Why would an avatar lie about his birth?

Now his ashram inmates are circulating nadi, or palm leaf, predictions, to prove his avatarhood. Trouble is that these nadis are all being manufactured by local entrepreneurs in Vaidheeswaran Koil. SUN TV which broke his mission also carried a documentary on the palm leaf predictions. Those too are mithya!


2. Nithyananda's basis for his spiritual quest was the 'enlightenment' at the age of 12 following an initiation by Annamalai Swamigal in Thiruvannmalai. If this was true, it must have left a deep impression on Annamalai Swamigal. But the detailed biography of Annamalai Swamigal by David Godman makes no mention of any child prodigy who met him. It was all in the mind of young Rajasekaran.

3. Nithyananda has spoken with tears in his eyes about his encounter with Arunagiri Yogeshwara, a fellow avatar. It is true that Ramana Maharishi had made references to Arunagiri Yogi. Perhaps Nithyananda's fertile imagination built a fairy tale around this reference along with the banyan tree, which we shall touch upon later. Nithyananda says he was given a saffron robe by this avatar and that no laboratory could analyse this fabric. The Police , we are sure, will be quickly able to do a forensic analysis and determine its miraculous origin.

4. Nithyananda has claimed that he was in parivrajaka or monastic wandering for nine years till his enlightenment. Parivrajaka means that one cannot stay for more than 3 days in any one location. When questioned, his ashram inner circle clarified that he started this at the age of 12 after his 'enlightenment' experience. Given that his age is a lie and the experience at 12 is another lie, is this also a lie?

Surely. Ramakrishna Ashram has records to show that a young Rajasekaran was with them for 4 years from 1996 till 2000. Till 1996 he was in a polytechnic studying. It must have been a very powerful parivrjaka indeed, perhaps wandering in his school, college and later in an ashram. We have a different name for such wanderers.

5. Now the bombshell. Nithyananda says he was enlightened on 1 January 2000 in the forests of Omkareshwar after 6 days of intense unclutching from Christmas day when he walked across the raging Narmada river.

If he was in Ramakrishna Ashram, did he have another body? Or was this 'enlightenment' another hoax? Or was he studying tantric sex somewhere?

None of these details are my creation. Factual records are available to support each point. But then, Nithyananda will say that his version is truth, not fact. That is why he is Mithyananda.

6. Let us now come to the foundation of his mission in 2002 or 2003. It is all about a poor banyan tree. Nithyananda says he had a vision to establish his mission and ashram under a banyan tree. His true Hanuman, read Danasekaran, then identified the tree in Bidadi. Nithyananda claimed that the Bidadi banyan tree is 650 years old. Problem is that the Police found the guy who planted this tree in Bidadi and he is only 70 years old! Perhaps the tree suffered from progeria like Amitabh Bachan did in Paa!

7. Nithyananda also said that the muneeswara buried under this tree came in the dream of the land owner and told him to gift the land to him. But a little bird told us in our waking state that Danasekaran alias Ayya paid cash to 'buy' the land but show it as gift. Convenient for both parties. Perhaps something here for tax people.

The Muneeswara became a swayambu linga, which in turn became Anadeshwara that in turn became the marble statue of Mithyananda!

8. Nithyananda claimed he was spreading the Vedic mind through his yogic body by establishing temples all over the world. Good thought and also very profitable. With his henchmen in Chennai and Thiruvannamalai, he created temple material and exported them at a huge margin through his private company nithyananda imports & exports. Who ran this company? His brother!

You may not know that running a temple is very good business but Nithyananda and his brother knew. It is also the best way to launder black money and also if needed to create cash. The Vedic mind was very sharp!

9. All what i have outlined till now is a fairy tale compared to what he did once the mission was established.

We have documents from 2005 that ashramites were made to sign for living and learning with the master. The voluntary signatories of these documents,which are semi-legal contractual agreements preventing those who signed from disclosing anything, agree to have sex with the master and others designated by him. The process will also include photography, videography etc guaranteed to provide spiritual ecstasy through sexual tantric practices. We are informed that in addition to the master, some key disciples may also enjoyed his privileges.

Contents of these documents have been published in English and vernacular newspapers and blogs. The documents are also with the Police.

Nithyananda's modus operandi was simple. Once he identified an attractive woman, or less often a male, one of his key disciples would send the girl to his inner chamber, ostensibly to massage his legs. The contact became closer after that. He would tell them that he was an avatar, a Shiva , a Krishna, and through union with him they would experience enlightenment. In technical terms, this was rape, since the woman was in no position to resist the sexual advances of the man who she had till then considered God. It was a hypnotic union. Once the job was done, the key disciples would ensure that the victim signed the non disclosure documents, in case that had not happened yet.

a very simple, but effective strategy, that some times was repeated several times a day. Several dozen women were victims and are still traumatized.

Was Nithyananda running an ashram or a perverted school for prostitution? What were the ashramites thinking when they signed these documents? Were they even aware of what they were signing? What would you do if your daughter, sister, wife, mother or friend was in the Nithyananda ashram?

Nithyananda also ran a gurukulam school for young children inside the ashram. Does your mind boggle?

10. People ask me why i have not gone public with information about other women or even men who had relations with Nithyananda the same way as SUN TV publicly displayed the Ranjitha videos. (Incidentally Nithyananda had told many senior followers who he called up from hiding to confirm that the SUN TV videos were true, while his ashram henchmen were still in denial mode.)

i am silent because i have related to these women and men as sisters, brothers and friends, who i respected and loved. I do not see any reason why they should suffer more than what they have suffered in the hands of Nithyananda. It is up to them as individuals to go to the Police if they wish to.

Would you have done differently if you were related to these victims, even if your blood boiled?

11. Nithyananda went into hiding once the videos were aired. Why, if he was innocent? He ran away like a common criminal, fearing for his life. When some senior religious leaders advised him to go on a true parivrajaka, he said, ' do you want me to die? do you think i will survive?'

When arrested he had enough money that would have kept an ordinary man in comfort for 5 years.

Do you still believe him? Do you still believe that all the kalpatarus at 1000 rupees and padapujas at 25000 rupees and house visits at one lac rupees had any truth or sanctity behind them. With great difficulty his mission's spin doctors found twenty people to give testimonials about these hyped up events. For every person who believed to have benefited, a hundred people were cheated.

If you were one of them who gave away money and feel cheated please stand up and complain to the Police. Cheating and defrauding people of money, even if it is only Rs 1000, based on false promises to provide wealth, health, relationship, success or peace is a crime, punishable under Section 420 as a cognizable non bailable offense.

Even if 10 people stand up and complain about how they were defrauded by Nithyananda, he can be put away. He will not have the chance to ruin the life of another wife, daughter, sister, mother or friend.

If after all this, you still believe that he is an enlightened being and god, it is your decision. But to me and many others who have studied the evidence against him, he is just a fraud and sex addict. He needs treatment in a correctional mental asylum.

He is an ordinary man, who acquired some powers that he misused. Now he has been arrested and the law will follow its course. If he had been anything more special, nothing like this would have happened. Many people may have been afraid of him so far. There is nothing to be afraid of a common criminal.

Please stand up and do what you believe as dharma! That will help this Vedic religion of Hinduism.

Please circulate this as widely as you can. The more number of people read this, the more intelligently they can make their choices. Please help.

Buddha Poornima - Celebrate A True Enlightened Master


BUDDHA POORNIMA - 27TH MAY 2010
 
Today, we would like to turn our attention to a real, genuine enlightened master - Buddha. Today is Buddha Poornima, the full moon day on which Buddha attained enlightenment. We wish all sincere seekers (especially all those who were drawn to Nithyananda due to their deep spiritual seeking, and have been fooled by his fraudulent words and actions) will continue their quest and be guided by a real enlightened master like Buddha.

Taking a last look at his new-born son and implanting a kiss on the feet of his wife, a prince of 29 years old came out of his palace at the dead of night and mounted on his dear horse in search of real happiness.

The next 6 years of extreme spiritual exercises costed the body of the prince heavily thus making him to forego the path of extreme hardships and choose the middle path between self-indulgence and self-mortification by accepting rice porridge from a village girl. 

The prince sat under a pipal tree with a firm resolve to realize the truth.

What was his resolve?

“Let my body dry up, as it were on this seat, let the flesh thereof and the bone sink into dissolution; without realizing that Enlightenment which is difficult to attain even in aeons, this body shall not rise from its seat.

49 days thus rolled off.

On the 50th day, the 35 years old prince became the enlightened one, the Buddha.

That was on Vaishaki Poornima day at Gaya, 2600 years ago.




Bahujana hitaya bahujana sukhaya,lokanukampaya,
arthaya hitaya sukhaya devananussanam

“for the good of many, for the happiness of many, for showing compassion to the world, for realizing the spiritual purpose of life, for your own good and as well as the god and happiness of all men and gods you have to dedicate your lives.”


Those were the words of Buddha to those who were around him on that day.

The next 45 years saw Buddha leaving no stone unturned in spreading his message of universal love.

Buddha spoke in the language then current in eastern India, Magadhi Prakrit.

He came out with his 4 noble truths.

1)      Suffering is an inherent part of existence
2)      The origin of suffering is ignorance the main symptoms of which are attachment and craving.
3)      The cause of suffering can be removed.
4)      The way for its removal is “Ashtangika marga – eight fold path”

The components of Ashtangika Marga are:

1)      right understanding
2)      right thought
3)      right speech
4)      right action
5)      right livelihood
6)      right effort
7)      right mindfulness and
8)      right concentration


The elapse of 2600 years brings us the common obstacle of “samsaya – doubtfulness about its present applicability” in our minds.  Let’s see what the recent incarnations say about Buddha.

Sri Ramakrishna, the avatara varishtha – the bst among incarnations, believed that the incarnation of Buddha continued to be manifest even then in the image of Puri of the “three gems” in the forms of Jagannath, Subhadra and Balaram.  On another occasion upon seeing the drama “Buddhacharita” staged by Girishchandra Ghosh, Sri Ramakrishna remarked, “It is certain that Buddha was an incarnation of God.  There is no difference between the faith founded by him and the Vedic path of knowledge.”


Swami Vivekananda in his later days narrated his vision of Bhagawan Buddha in the following words:

“One day, when I was sitting …I saw the extraordinary figure of a monk appear suddenly, from where I did not know, and stand before me at a little distance filling the room with a divine effulgence.  He was in ochrecloth with a Kamandalu in his hand.  His face bore such a calm and serene expression of inwardness born of indifference to all things that I was amazed and felt much drawn towards him. He walked forward towards me with a slow step, with his eyes steadfastly fixed on me, as if he wanted to say something.  But I was seized with fear and could not keep quiet.  I got up from my seat, opened the door and walked out of the room with rapid step.  The next moment I thought,” Why this foolish fear?” I made bold and went back into the room to hear the monk, who, alas, was no longer there.  I waited long in vain and felt dejected, repenting that I had been stupid enough to fly away without listening to him.  I have seen many monks, but never have I found such an extraordinary expression in any other face.  That face has been indelibly imprinted in my heart.  It may be a hallucination, but very often it comes to my mind that I had the good fortune of seeing Lord Buddha that day.”



Vivekananda was fond of addressing Buddha as “the great preacher of the brotherhood of mankind.”

“Among all the prophets of mankind here was a man who never had any cobwebs in his brain and who was sane and strong “said Vivekananda.    

Tibetan Spiritual leader Dalial Lama will inaugurate the country’s first-ever Buddha Smiriti Park, sprawling 22 acres, in the heart of the city of Patna on Thursday morning, the 27th May 2010, the Budhha Poornima Day.  The first-of-its kind park will house a 200-ft stupa containing holy relics from Japan, Thailand, Myanmar and South Korea and two saplings, one of the Mahabodhu Tree of Gaya and another from Sri Lanka.


The sight of an old man, a sick person, a dead body and a monk just only for one time was sufficient for a  29 year old prince Siddharth who was having all wealth and sense pleasures around him to understand the depth of all worldly pleasures.

6 years of hard austerities gave him the right direction in his search for Truth.

50 days was enough for him to have the Truth in experience.

May all of us pray for His blessings and love in realizing the Truth in this birth itself.!

HC adjourns Nithyananda's bail application to June 8

Karnataka High Court on Wednesday adjourned hearing in the bail petition of self-styled godman Nityananda Swami, arrested on criminal charges including rape, to June 8.

When the case came for hearing before Justice Subhash B Adi, the CID police sought more time to conduct investigation.

However, Nityananda's counsel contended that there were "no victims or witnesses" in the case and it was admitted by the investigating agency.

After hearing the arguments of both sides, Justice Subhash Adi adjourned the hearing to June 8.

Meanwhile, a writ petition filed by the counsel against freezing of bank accounts of four trusts, of which Nityananda is a trustee, was adjourned to June 4.

Also, the judicial custody of Nityananda, which ended today, has been extended till June 9.

Nityananda landed in a controversy in March after local TV channels aired purported video footage showing him in a compromising position with a Tamil actress. He was arrested from Solan in Himachal Pradesh on April 21.

Nithyananda is in the news after he was shown on private television channels in a compromising position with a woman.

Both Nithyananda and Bhaktananda have denied all the allegations levelled against them and have sought bail.

'Rescue my family from Nithyananda's custody'

TIRUNELVELI: Urging the police to rescue his wife and two children from the custody of Swami Nithyananda and his disciple Osho Mani, a fruit shop owner from Palayamkottai lodged a complaint with the Tirunelveli city police commissioner on Friday.

In the petition, K Sagaya George (43) of Samathanapuram in Palayamkottai said that he had married his sister's daughter, Arokya Vimala 15 years ago and the couple had two sons. In 2005, Arokya Vimala became ill, and they came to know about a doctor Osho Mani of Udayarpalayam in Salem district through an advertisement in a newspaper.

When they visited him, Osho Mani said that he was the chief disciple of Swami Nithyananda and in the name of giving treatment and teaching acupuncture, he charged Rs 50,000. He also got Rs 25,000 from Arokya

Vimala for a financial scheme and enrolled her as an agent in the scheme without Sagaya George's consent. Osho Mani told her that if Rs 5,000 is given every month for the scheme for 25 years, they would get Rs 15 lakh as refund. Sagaya George further said that Osho Mani took her to Nithyananda's meetings and his 'dhayana pedams' and made her place photos of Nityanada and Osho Mani in her house and do poojas. Moreover, Osho Mani took his wife and two children to Chennai and put them under his custody. "He did not allow me to see my wife and children", Sagaya George added.

When George contacted him over phone, Osho Mani said that his wife and children were at Nithyananda's ashram in Bangalore and directed him to ask Nithyananda about them. In this circumstances, he came to know through newspapers that Nithyananda was arrested on charges of sexual abuse and he approached the police.

"Please take action against Osho Mani and Nithyananda and rescue my wife and two children", Sagaya George requested the police in his petition.

When Express contacted Tirunelveli city police commissioner AK Singh, he said that after receiving the petition, he had sent it to the respective police officials. Enquiry was on, he added.

Man seeks cops' help to save wife, 2 sons from sex swami Nithyananda’s Ashram
Tirunelveli: Incarcerated fake god man, Swami Nithyananda, was facing yet another charge of keeping captive the wife and two sons of a fruit vendor at an undisclosed ashram.
Sahaya George (40), hailing from Samadhanapuram in Palayamkottai, today lodged a complaint with City Police Commissioner Abhay Kumar Singh saying his wife S Arockiya Vimala (33) and two sons S Arun Prakash (13) and S Ajay Andrew (11) were being kept captive in an undisclosed ashram of Swami Nithyananda and sought the police help to rescue them.
In his complaint, George said his wife suffered acute stomach pain two years ago and was taken to an acupuncture doctor, Osho Mani at Udayarpalayam near Athur in Salem District for treatment.

Nithyananda Bail Plea Hearing Adjourned to May 26th

The High Court on Tuesday adjourned the hearing on the bail plea of self-styled godman Nithyananda to May 26 along with that on his petition seeking defreezing of bank accounts. 

In the course of investigation into the sex scandal involving Nithyananda and Tamil actor Ranjitha, the CID has discovered 12 bank accounts, one of which had a deposit of over $ 7million (Rs 32 crore).
These accounts as well as financial dealingS of the trusts are being probed by the Enforcement Directorate and Income Tax department.

According to State Police, the Tamil Nadu police, while registering the case, had asked the banks to freeze these accounts to avoid misuse of money.
Nithyananda, in his petition, has said that the accounts be defreezed as the money is required to run the ashram.

The godman now in judicial custody has also moved the High Court seeking bail after the lower court rejected his bail application. Justice H S Kempanna adjourned hearing.

May 18: The Karnataka High Court on Tuesday further adjourned the hearing on the bail plea of controversial ‘godman’ Nithyananda Swami to May 26. Nithyannada had approached the court after a lower court rejected his bail plea.
Meanwhile, the court also adjourned a batch of petitions by four trusts operated by Nithyananda challenging the CID sleuths freezing his bank accounts as part of its investigation into the alleged sex scam. Justice B.S. Patil adjourned the petitions related to the freezing of his bank accounts.
The CID had communicated to the ICICI, Corporation and Canara Banks to freeze the accounts in the names of Dhyanapeeta Charitable Trust, Nithyananda Foundation, Nithyananda Dhyanapeeta, and Nithyanandeshwara Devasthana. The four trusts, run by Nithyananda, have challenged the CID action by filing petitions before the high court. The petitioners alleged that the action of the CID sleuths in freezing the banks accounts is in violation of the Supreme Court order in Kanchi Sankaracharya case.
Nithyananda had approached the high court on earlier occasions seeking a stay on the police investigation and to quash cases filed against him, which have been adjourned to May 26 for further hearing by the court. The CID sleuths have informed the court that they have collected evidence from at least 35 witnesses on the matter, and have also seized 23 hard disks from the Bidadi Ashram acting upon the search warrant issued by a lower court in Ramanagara. The bail plea of Nithya Bhaktananda, a disciple of Nithyananda, has also been adjourned to May 26 along with Nithyananda’s petition.
STAY ON DEMOLITION

The state high court on Tuesday stayed the demolition drive taken up by Bangalore Development Authority at Geddalahalli, RMV II stage. The court passed the orders after hearing a petition by owners of the houses demolished at Geddalahalli village near Sanjaynagar. The BDA had razed unauthorised structures on survey numbers 1/1, 1/2 and 1/4 of Geddalahalli village, and recovered 1.14 acres of land. It had brought down six RCC structures and 10 sheds.
According to the BDA, the land was originally acquired for RMV 2nd stage Layout in 1997 and encroached upon by some miscreants. Later, the recovered property was fenced by the BDA authorities.
Meanwhile, the petitioners alleged that as per BDA rules, if such land is not claimed within five years, it would automatically lapse. They further alleged that the BDA had undertaken the demolition drive without prior notice.

Swami Nithyananda had secret classes, even for tantric sex

The self-styled Godman, Swami Nithyananda seems to have made a lot of money from people who trusted him blindly. Nityananda Swami has proved himself to be a bit too smart with a typical type of business too. Swami reportedly used to provide inner awakening programs. These classes lasted for 15 days and this was, most importantly put up for foreign devotees. He used to charge $5,000 per course, which is approximately Rs 2.25 lakhs and was indeed a whooping amount.

This was known to be the major source of revenue stream for the Dhyanapeetam Ashram which is run by the controversial Godman. He harvested more than Rs. 35 crore, exclusively from this one program. This swami conducted a special program known as Devi Darshan which he conducts only once a year. On this particular day, Nityananda Swami used to dress up like a woman with godly appearance. And it was believed that if they touched him, the wishes of the devotees would be granted.

All there details were unearthed by the CID which has taken up the task to investigate the Godman after his recent scandal with a Tamil actress. It was also found that the Ashram held different programs for four categories of devotees. And those who were interested were forced to sign in a non-disclosure agreement. Interestingly, this agreement included a clause on Tantric sex too.

For those who wanted to join the Ashram, it was a must for them to attend the four levels of the program. It all started with Atma Spoorna for two days, Nithyananda Spoorna for four days, Bhakti Spoorna that lasted for seven days and finally was the Nithyananda Program that went on for about 15 days.

Nithyananda’s bail plea hearing adjourned

BANGALORE: The Karnataka High Court today adjourned hearing of the bail plea of self-styled godman Nithyananda Swami, arrested on criminal charges including rape, to May 18.

Justice V B Pinto adjourned the hearing when the bail plea came up before the vacation bench.

The Sessions court at Ramanagara, 40 km from here, had yesterday extended Nithyananda's judicial custody to May 26.

Nithyananda landed in a controversy in March after local TV channels aired purported video footage showing him in a compromising position with a Tamil actress. He was arrested from Solan in Himachal Pradesh on April 21.

Nithyananda's judicial custody extended till May 26th!

Ramanagara (Kar), May 12 (PTI) A local court today extended the judicial custody of self-styled godman Nityananda Swami, arrested on criminal charges including rape, till May 26.

Police informed Sessions Court judge Vijayalakshmi that they were not in a position to produce Nityananda today as its personnel have been drafted for security for the gram panchayat polls.

The judge accepted the plea for extension of judicial custody.

Meanwhile, Nityananda has hired the services of a Mumbai based law firm to replace Chandramouli, who withdrew from his cases. Vedavyas and Vivekananda Gupta of Nitin Prasad Associates, Mumbai would appear for Nityananda.

Nityananda landed in a controversy in March after local TV channels aired purported video footage showing him in a compromising position with a Tamil actress. He was arrested from Solan in Himachal Pradesh on April 21.

Nithyananda's custody ends today in the case that was filed by KA CID police. Following this CID provided more evidence against Nithyananda at the Ramnagar district court, and requested an extension of his custody.

Self-styled godman Nithyananda’s legal battle to prove his innocence has claimed its first victim, as his advocate has opted out.


Advocate H S Chandramouli, who had been representing Nithyananda in all the cases pending against him in Ramanagar, Bangalore and Chennai, has given a no objection certificate in court paving the way for the appointment of new legal counsel for the godman, who finds himself embroiled in charges of rape, unnatural sex, hurting religous sentiments and criminal intimidation.

Advocate Chandramouli cited his inability to attend to all the cases of the godman in the three cities, as it would affect his court appearances with regard to other clients.

Speaking to Deccan Herald he said: “I have cases pending in sessions courts and other circuit benches, so it is unreasonable to be expending so much time on one case.”

The advocate admitted that he was unaware that the case would drag for such a long time and it was becoming increasingly difficult to maintain appearances everywhere. “When he was arrested, I had to go to the jail, speak to the authorities take instructions on a regular basis. My client is innocent, but how long could I continue this?” he questioned.

The overwhelming negative publicity the case has gathered has contributed to its slow progress, hampering his other cases, he claimed.

When asked if he was being shown the door as the godman was unhappy with the way his anticipatory bail case was handled, Chandramouli shot back saying that Nithyananda was free to have his counsel changed anytime he wanted and he did not have to wait this long to do so.

The case is now expected to be handled by Delhi-based advocate Pradhan.

Sex-tainted Swami Nithyananda, who is currently lodged in the Ramanagaram jail following the rejection of his bail plea by a court there, will now have to look to a new advocate to help him out of his legal troubles. His lawyer, H S Chandramouli, has decided not to represent the Swami in any court in the future.

Speaking to Bangalore Mirror, Chandramouli, who was once a special public prosecutor for the state in the high court, said, “I am opting out of the case. A New Delhi-based lawyer may take over the case from me very soon. I will issue a No Objection Certificate in this regard.” He added, “Nobody has asked me to withdraw from the case. It was my voluntary decision.”

Explaining the reasons for his decision, Chandramouli said, “In the beginning itself, I had told the Swami’s people that I would represent him in the court till he got bail. I had also made it clear to them that I am a high court advocate and will not argue before a Ramanagaram court. I had also told them that I will not go to Puducherry or any place other than Bangalore to get relief for the Swami. His people want me to represent him all over the country, and this is not possible for me. So, I gave up his case.”

Meanwhile, it is learnt that Nithyananda’s supporters have hired a senior lawyer from New Delhi to get bail and other relief for the jailed Swami, whose bail application was rejected by a Ramanagaram court.

According to sources, as per a previous plan, Chandramouli should have filed a review application seeking bail for the Swami in the high court. But Chandramouli dropped the plan on coming to know that a Delhi-based lawyer is going to make his intervention in the case.

Apart from a case in the Ramanagaram court, Nithyananda faces the legal process in Puducherry and Tamil Nadu’s Sriperumbudur, where arrest warrants await him.

To be able to come out of the Ramanagaram jail and avoid being arrested by the Tamil Nadu and Puducherry police, the Swami will have to obtain bail from the Karnataka High Court and anticipatory bail from the courts in Sriperumbudur and Puducherry. All this will have to be managed by his new advocate.

Nithyananda wanted to make hay on short selling hedge fund

The primary ''investment'' objective of the hedge fund promoted by Nithyananda, the godman now in judicial custody in a Ramanagara prison, was the ''growth of capital and to seek above market returns'' and ''long-term appreciation'' by investing primarily on American and non-American stock markets.

A "confidential private offering memorandum" of the Nithyananda Investment Fund I, LP (limited partnership), which is in the possession of Deccan Herald, outlines the ambitious, unrestrained profit motives of the Fund that was managed by the Nithyananda Capital Management, LLC (limited liability company).

Deccan Herald exposed in its May 3 edition that Nithyananda was an executive officer and general partner in the Fund that was established with an initial investment of $1.55 million by nine "accredited" and one "non-accredited" investors.  The Fund had its business address in Orlando, Florida.

While claiming that the "there can be no assurance that the Fund will achieve its investment objectives", the document says a second objective of the partnership was to deal in "equities, fixed income, warrants, rights, options and money market instruments". Another interesting target of the Fund, which clearly establishes that it was "hedging", was its high risk "short selling of securities and margin transactions".

Among some of its other goals, the Fund promised investing or trading in "cash commodities, commodity futures, or commodity options contracts".  While claiming that the Fund "is authorised to invest or trade in all types of equity and debt securities…from time to time, the Fund will have cash which will be held in the custody of a bank or broker dealer firm and will be invested in short term instruments including, but not limited, to commercial paper, bank certificate of deposits, US treasury bills and similar instruments".

According to the document, the securities in which the Fund preferred to invest in "are traded on US and non-US national securities exchanges and well-recognised established financial markets". The Fund filed its last annual report with the Florida Secretary of State's office on January 25, 2010.

Bail plea rejected

The District and Sessions Court of Ramanagar rejected the bail application moved by godman Nithyananda on Thursday. District judge C J Hungund observed that the allegations against Nithyananda were serious in nature and that he was likely to deviate the case and destroy evidences.

Nithyananda had pleaded innocence in the petition. The Puducherry police, who have secured body warrant from a court, are waiting to take the goodman into their custody for an investigation in a separate case. At present, Nithyananda is lodged at Ramanagar jail

The self-styled godman landed in a controversy in March after TV channels aired video footage purportedly showing him in an objectionable position with a Tamil actress.

BANGALORE: The alleged financial fraud committed by Swamy Nithyananda will be investigated by the Central agencies including the Directorate of Revenue Intelligence.

DIG (CID) Charan Reddy told the Express on Tuesday that the information collected during Nithyananda’s interrogation on financial issues and his overseas business details were handed over to the Central agencies.

He said the rape charges against Nithyananda would be investigated only if the CID was able to record the statements of the victims.

CID is waiting to record the statements of Tamil actress Ranjitha, he said.

“CID has already contacted her advocate and issued notice to her through him asking her to give her statements before the investigating officers,” Reddy said. “We will issue notices till she presents before us. If she does not, the criminal procedure code provides for detaining her.” Meanwhile, one of the victims is willing to give a statement on the rape charges against Nithyananda.

“The only thing is that the victim has to feel free to give statements before the CID. Thereafter, CID can easily investigate the rape charges,” he said.

“If that happens, then I hope many more victims will come forward to register complaints against the Swamy,” Reddy said. However, he declined to comment on the whereabouts of the accused and said that this was not the right time to disclose the same.

The infamous ''confidential non-disclosure agreement'' that two of arrested godman Nithyananda's associates signed with no less than 35-40 devotees, mostly females, is believed to have been drafted in 2009 in the United States.

The non-disclosure agreement which, among other things, was essentially drawn up for Nithyananda to engage in explicit sexual activities with some of his devotees in the name of Tantra, virtually gave the godman carte blanche to participate in "the use of sexual energy for increased intimacy/spiritual connection, pleasure etc. Deccan Herald first highlighted the existence of such a non-disclosure agreement in its April 13 edition.

According to reliable sources, a preliminary analysis of the some of the seized hard disks and examination of some witnesses suggests that even though the agreement was prepared and soft copies were emailed to a senior Nithyananda associate in 2009, the devotees were asked to sign them with a "back date". The hard disks were sent for date recovery and analysis.

"It suggests that the sole purpose of the so-called agreements was aimed at entrapping some ashramites to engage in sex and other forms of unnatural sex," an official said, adding that "it clearly establishes the motive and an intent aimed at having sex".

The CID has been able to examine and record the statements of some of the devotees who are believed to have signed the agreements with back dates.  Sources said that one close female Nithyananda devotee was asked to sign with the September 5, 2005 as the date.

In another instance, a situation was contrived whereby a senior female devotee per force signed on, although she had vehemently objected to the contents of the agreement when she read it the first time. This particular devotee signed the document with a 2005 date. It is in this context that the non-disclosure agreements assume legal importance in the light of the CID's discoveries from the retrieved hard disk data.

Nithyananda often told his disciples and devotees that he was different and extrmely spiritual from a very young age. He said when he was younger he never did what kids his age did. He even claimed he never watched movies, except spiritual ones!

Ranjitha made her debut in Tamil films when she was cast in the lead role by director Bharatiraja in the movie 'Nadodi Thedral'. When the movie was released it was watched by a young Rajasekaran (alias Nithyananda) in Tiruvannamalai, at that time in his 10th class. It must have been love at first sight, because after watching that movie, Shivakumar tells how Rajasekaran always carried Ranjitha's photo in his school bag, along with the pictures of Gods that he had with him all he time! Mr. Shivakumar is surprised that after all these year, he did make his dream come true with his first love

Nithyananda was US hedge fund promoter

Self-styled godman Nithyananda’s hedge fund that operated in the United States was named Nithyananda Investment Fund I, LP (limited partnership), according to investigations by Deccan Herald.

Another entity that managed the fund was called Nithyananda Capital Management LLC, or a limited liability company. The Fund was incorporated in November 2007 with its business address as 113 N, Econolockhatchee Trail, Orlando, Florida.

Deccan Herald is in possession of irrefutable documentary evidence that show Nithyananda promoted the Fund, though it was managed by his trusted aide Rajesh Krishnan and a Taiwanese national Shuping Lin.  In the United States Securities Exchange Commission’s (SEC) Form D, filled out as a notice for sale of securities, Nithyananda’s name figures as one of three promoters of the Fund.

The same form describes the Fund as “a private investment company making investments in and trading listed securities, over the counter securities and public offerings”. Under Rule 506 of the US Securities and Exchange Commission, the Fund had exemption to “raise an unlimited amount of money”.

As someone who ran declared charitable trusts based in Bangalore, Nithyananda’s direct involvement in the hedge fund is shown in documents that state that by September 30, 2008, the Fund traded securities to the tune of $1.55 million. The Fund’s objective was to trade on the stock market for an “indefinite” period and for “indefinite” securities sale. The minimum investment that was accepted from any individual partner was $50,000.

Documents available with Deccan Herald show nine “accredited” or “sophisticated” investors — those who have “sufficient knowledge and experience in financial and business matters to make them capable of evaluating the merits and risks of the prospective investment”.  Besides these, securities offerings were sold to one person who did not qualify as an accredited investor.

In one sale of securities, according to a Form D document signed and dated on February 2, 2009, two accredited investors purchased securities worth $125,000 and the sole non-accredited investor purchased securities to the tune of $50,000. The “gross adjusted proceeds to the issuer” (the Fund) was $89,137.50, after deductions of “salaries and fees, printing and entity formation”.

Responding to Deccan Herald’s enquiries, Raj Krishnan said in an email: “There was never any involvement of the Fund with the operations of the Foundation/Non-Profit in (the) US or anywhere else. I never took money from the non-profits and never would have.”

The bank accounts and earnings of Nithyananda’s two charitable trusts - Dhyana Peeta Charitable Trust and Nithyananda Dhyanapeetam - are now under the scrutiny of the Enforcement Directorate (ED).

The ED is also probing his personal account in a private Indian bank where the total deposit is about Rs 32 crore to establish whether the godman, now in judicial custody at the Ramanagara district jail, has violated FERA and FEMA provisions.

Bangalore, May 1: The walls are closing in on Swami Nithyananda as the much-awaited report from the Hyderbad forensic lab has established that the man seen in the sex tape was in deed the godman from Karnataka.

The Karanataka Criminal Investigation Department (CID), which is probing into the criminal cases slapped against Nithyananda following the leak of a sex tape, has been waiting for the confirmation from the forensic science laboratory in Hyderabad to nail the Swamiji, who has been denying all the charges.

As per inputs, the forensic lab has confirmed the authenticity of the sleaze tape showing the Nithyanada's sexual romp allegedly with Tamil actress Ranjitha.

This report puts an end to the tiring arguments of the godman that his image was morphed into the tape and that he was a victim of a conspiracy.

As many as 30 sex tapes showing the godman indulging in sexual activity with at least five women were submitted to the CID by Nithyananda's associate Lenin Kurupan, who plotted the whole thing to expose Nithyanada's activities.

Now, the CID is trying to get hold of Ranjitha for interrogation. Two months after the sleaze tape hit the media, the actress on Apr 30 claimed that she is not the woman in the sex tape and has slapped legal notices on Google and Youtube seeking removal of the videos.

Since Nithyananda's police custody ended on Friday, Apr 30, a court in Ramanagara in Bangalore sent the godman to judicial custody till May 12.

BENGALURU: The forensic science laboratory in Hyderabad has nailed godman Nithyananda Swami, saying the image in the sex video was his and not morphed as being alleged by the arrested spirtual guru.

Criminal Investigations Department officials has sent the video showing him in company with Tamil actress Ranjitha to FSL to verify if the images were real.

Nithyananda has told the investigators that he was a victim of blackmail and duplicity and that the images were morphed to ruin his image.

But the FSL report has confirmed that it was Nithyananda in the controversial video where he is seen in a compromising position with Ranjitha.

Nithyananda, who has been stonewalling the probe by faking illness and remaining silent, is in police custody till April 30.

The CID is trying to secure Ranjitha for interrogation. The actress went untraceable after the tape made it to the press, last month. An interrogation with the actress is expected to throw more light on the issues that surrounds the controversial god man. The CID is in possesion of some sleazy tapes involving Nithyananda. They contain footage of Nithyananda with some more women.

" If the court thinks I have done any wrong, it can hang me,” Nithhananda told the court which remanded him to custody till Friday.

The CID has sought medical tests to determine his sex.

Breaking News: Controversial godman Swami Nithyananda has been sent to judicial custody till May 12. He spent eight days in police custody. Nithyananda reportedly denied all charges made against him.

A court in Ramanagara in Bangalore remanded the 32-year-old Swami Nithyananda to jail after expiry of his police remand.

Nithyananda was arrested in Solan district of Himachal Pradesh and was brought to Bangalore on a transit remand. He was involved in a sleaze video tape with a Tamil actress, which was telecasted by many TV channels in Tamil Nadu and Karnataka.

Nithyananda has now claimed that he is not a man at all, and has asked the CID to do a potency test on him. He made the statement to the CID when he was brought to Bangalore after being arrested in Himachal Pradesh. The CID crosschecked Nithyananda's passport which mentions that he is a male and not a transgender.

The CID is on the lookout for Nitya Gopika, the former associate of Nithyananda, who was involved in smuggling gold. Police suspect that the woman was in league with Lenin Kuruppan to expose Nithyananda to the world.

Earlier it was revealed that the godman's Dhyanapeetam Ashram at Bidadi featured Nudity, sexual activity, and physical intimacy as a part of 'learning and practice of ancient tantrik secrets'. Moreover, the devotees at the ashram were forced to sign a Non Disclosure Agreement that prohibited them from disclosing any of these details or taking legal recourse after practising 'ancient tantrik secrets'. The CID have acquired these Non Disclosure Agreements when the ashram was raided a few daya ago. Computer hard disks, laptops and mobiles that contained volatile information were also seized. Most of those who enrolled for this programme were women, and 90% were from Tamil Nadu. About 35 video clippings of Nityananda in compromising positions with at least five women have been found by the CID.

Nithyananda was shown on news channels having sex with two women via a spy camera. The clip was part of a sting operation on the Swami, who is seen in compromising positions with two Tamil actresses Ragasudha and Rajitha. In another shocker, it was revealed that Nithyananda had tried to murder a resident at the Nithyananda ashram at Bidadi near Bengaluru because the godman had found out that he had filmed his sex tape. Nithya Premananda, alias Lenin Karuppan,has petitioned the Chennai police seeking protection from Nithyananda. He complained that he was chased down by Nithyananda's goons from Bengaluru right up to Salem and that he was lucky to escape to Chennai.

According to the police Lenin had sent across 63 copies of the sex tape to various media houses and other institutions, besides important persons across the country and 23 more to the Nithyananda ashrams and devotees abroad. There was also a 5-page letter from a 23-year-old woman, an inmate of the Bidadi ashram who claimed that Nithyananda had raped and sexually harassed dozens of women in the ashram.
