Setback for Nithyananda: HC restores show-cause notice

CHENNAI: Spelling trouble for godman Nithyananda, a division bench of the Madras high court has stayed a single judge order quashing the state government's show-cause notice to take over his ashram at Tiruvannamalai

A bench comprising Justice Elipe Dharma Rao and Justice M Venugopal stayed the single judge order dated January 30, on a writ appeal filed by the Hindu Religious and Charitable Endowments (HR&CE) department, and issued notices on Thursday. 

On October 11, 2012, the department issued a show-cause notice asking the administrators of Nithyananda Dhyanapeetam why the ashram should not be taken over in view of violation of trust conditions and other issues such as collection of donations from devotees. 

Assailing the notice, the ashram approached the high court saying it was not a Hindu religious institution, as it taught yoga and meditation, besides having Buddha idols inside the premises. 

On January 30, Justice Chandru allowed the petition of the dhyanapeetam manager Nithya Prananada, saying, "The fact that some Hindu idols were found in the trust would not make it a Hindu institution, since for its consecration, no agamas were followed. The mere presence of the flagpost does not make it a Hindu religious institution." 

In its appeal, the department said the single judge should not have entertained the petition as it was only a show-cause notice calling for explanation from the ashram authorities. It said, "Taking advantage of the order, the ashram may continue to perform activities of religious nature and conduct rituals". 

The department has to remain a mute spectator to the illegalities at the ashram, it said, adding that following the footsteps of Nithyananda Dhyanapeetam, there is every chance that other similar institutions throughout the state will flout rules and the department will not be able to take action against them, the appeal said.
